Terms of Service
These are the terms that apply when you use Winly. Please read them. If something is unclear, write to us at support@winlyonline.com.
1. About Winly
Winly is operated by Winly Technologies Ltd, a company registered in England and Wales under company number 17217900, with a registered office at 2nd Floor, College House, 17 King Edwards Road, Ruislip, London, HA4 7AE, United Kingdom. In these Terms, "Winly", "we", "us", and "our" mean Winly Technologies Ltd. The Winly platform is available at winlyonline.com.
2. What Winly is
Winly is a customer loyalty platform built around a cashback prediction game. When you transact with a partner business (a "Provider") in person at their venue, the Provider records your sale on Winly. Once the Provider has remitted the commission owed on that sale to Winly, you are invited to play a short prediction game on the Winly app. If your pick wins, a percentage of your sale is sent to you as cashback.
Winly is not a payment processor for in-person sales. You pay the Provider directly using whatever method the Provider accepts. Winly does not take or hold any money on your behalf for the underlying purchase.
3. Eligibility and your account
You register using your mobile phone number, which is your identifier across the platform. Keep your account details accurate and your access credentials private. You are responsible for activity that happens on your account.
If you sign in on a shared device, sign out when you are done. If you suspect someone else is using your account, contact us at support@winlyonline.com.
4. How cashback works
- You buy something from a Provider in person and pay them directly.
- The Provider records the sale on Winly against your phone number and remits the commission they owe to Winly.
- Once Winly confirms the commission, we send you a notification inviting you to make your game pick.
- You open the app and submit your pick during the game window.
- When the game is resolved, winning picks earn cashback, calculated as a percentage of the sale amount. The percentage in effect at the time of your sale is the one that applies; later changes do not affect older sales.
If a game is not currently open when your sale is confirmed, your entitlement is held and you can play in the next available game. You are not penalised for waiting.
5. Game picks
Each game has a fixed game window. Picks are made on the Winly app only. Once you submit a pick, it cannot be changed. One pick per user per game.
Winly designs and operates the game. Providers do not influence outcomes. We may, at our discretion, void picks that we reasonably believe were obtained through fraud, automation, or any breach of these Terms.
6. Receiving your cashback
When your pick wins, your cashback is sent directly to you. We will tell you in the app when the payout has been initiated and confirm it once it is on its way.
Payouts may be subject to identity checks or other reasonable controls that we apply to keep the platform safe. We will tell you in the app if any controls apply to your payout.
7. What you must not do
You agree not to:
- register sales that did not happen, or arrange with a Provider to record a sale that did not happen;
- use someone else's phone number, a placeholder phone number, or multiple accounts to obtain or amplify cashback;
- automate, scrape, or otherwise interact with the platform other than as a human user through the Winly app;
- attempt to access another user's account or data;
- use Winly for anything illegal under the laws that apply to you.
Breaching this section may result in voided picks, forfeited cashback, suspension, or termination of your account, and we may cooperate with law enforcement where appropriate.
8. Suspension and termination
We may suspend or close your account at any time if we reasonably believe you have breached these Terms, if we are required to do so by law, or to protect the platform from abuse. Where possible we will tell you why. You may close your account at any time by writing to support@winlyonline.com. Closing your account does not remove your obligation to settle any prior dispute, and does not affect cashback that has already been paid out.
9. Provider goods and services
Winly does not sell, supply, or deliver the goods or services you buy from a Provider. The Provider is responsible for what they sell you. Complaints about the goods or services themselves (quality, fitness for purpose, refund policy, food safety, and so on) are between you and the Provider. We will try to help where we can and may forward your complaint to the Provider; the Provider is required to respond within 48 hours.
10. Intellectual property
The Winly platform, including its software, design, brand, and content, is owned by Winly Technologies Ltd or licensed to us. You may use the platform for its intended purpose. You may not copy, modify, reverse engineer, or build a competing service from it.
11. Disclaimer and limitation of liability
We work hard to keep Winly working, but we provide the platform "as is" and "as available". To the maximum extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or lost opportunity. Nothing in these Terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence or for fraud.
12. Governing law
These Terms are governed by the laws of Lebanon. Disputes are subject to the exclusive jurisdiction of the courts of Lebanon, except that we may bring proceedings to recover unpaid amounts or to seek urgent relief in any court that has authority over you.
13. Changes to these Terms
We may update these Terms. If we make a material change, we will notify you in the app or by message. Your continued use of Winly after a change means you accept the updated Terms. If you do not accept a change, you should stop using Winly and may close your account.
